Agreement to these terms
These Terms of Use are an agreement between you and Orbit (“Orbit,” “we,” or “us”). By creating an account, joining a family, or using the app or supporting services, you agree to these terms and our Privacy Policy. If you do not agree, do not use Orbit.
If you use Orbit for a child or invite other people, you confirm that you have the authority and permissions required to do so. These terms do not remove consumer rights that cannot legally be waived.
What Orbit is, and is not
Orbit is a family-coordination service that can show shared locations, compare location with a family plan, organize calendar events and family content, deliver alerts, and provide an SOS feature.
Accounts, families, and children
- You must be legally able to enter this agreement to create or administer a family.
- A child profile must be created and managed by a parent or legal guardian with the right to do so. Children must not independently create or administer a family.
- You must provide accurate information and keep sign-in credentials and verification codes confidential.
- You are responsible for activity under your account and for choosing trusted members of your private family group.
- You must promptly remove a person or disable sharing when you no longer have permission to include them.
License and ownership
Orbit grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and service for lawful family-coordination purposes, subject to these terms and the applicable app-store rules. Orbit and its licensors retain all rights in the app, service, branding, software, and materials that are not expressly granted to you.
For downloads from Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement also applies unless a custom license agreement is provided in App Store Connect. If these Terms conflict with mandatory App Store terms, the mandatory terms control for that use.
Your content
You keep ownership of content you submit. You give Orbit a limited, worldwide license to host, store, reproduce, process, transmit, and display that content only as needed to operate, secure, and support Orbit for you and your authorized family members.
You are responsible for your content and must have the necessary rights to share it. Do not upload unlawful content or content that violates another person’s privacy, safety, intellectual-property, or other rights.
Acceptable use
You must not:
- track, monitor, contact, or add anyone without the notice, consent, or legal authority required where you live;
- use Orbit to stalk, harass, threaten, exploit, discriminate against, or harm anyone;
- access or attempt to access another family’s account, content, or systems without authorization;
- interfere with the service, evade security or rate limits, introduce malicious code, or probe for vulnerabilities without written permission;
- reverse engineer, copy, resell, sublicense, or commercially exploit the service except where applicable law expressly permits it; or
- use Orbit in violation of law, sanctions, export controls, or another person’s rights.
We may investigate violations and restrict or suspend access when reasonably necessary to protect people, families, Orbit, or the public.
Subscriptions and billing
Orbit may offer free and paid features. Prices, billing periods, trial terms, and included features are shown before purchase. App Store subscriptions are processed by Apple and automatically renew unless cancelled at least 24 hours before the end of the current billing period, subject to the terms shown by Apple at purchase.
You can manage or cancel an Apple subscription in your App Store account settings. Deleting the app or an Orbit account does not automatically cancel an App Store subscription. Refund requests for App Store purchases are handled under Apple’s policies. Taxes and price changes may apply as disclosed by the store.
Third-party services
Orbit depends on services provided by operating-system, map, hosting, email, authentication, notification, analytics, attribution, and app-store providers. Their own terms and privacy policies may apply. We are not responsible for third-party services or for interruptions, changes, or information they provide, except to the extent required by law.
Changes and availability
We may add, change, suspend, or discontinue features to improve or protect the service, comply with law, or respond to circumstances outside our control. We will provide reasonable notice when a change materially reduces a paid service, unless urgent security, legal, or safety reasons make advance notice impractical.
We may update these terms. We will update the effective date and provide additional notice before materially changed terms apply when required. Continuing to use Orbit after the applicable date means you accept the updated terms.
Ending your use
You may stop using Orbit at any time and can delete your account in Settings. An authorized organizer can delete the family. We may suspend or terminate access for a material or repeated breach, unlawful activity, a serious risk to people or the service, or if we discontinue Orbit.
Terms that by their nature should survive termination remain in effect, including ownership, content responsibility, disclaimers, liability limits, and dispute provisions.
Disclaimers and liability
To the maximum extent permitted by law, Orbit is provided “as is” and “as available.” We do not guarantee uninterrupted operation, delivery of an alert, location or ETA accuracy, preservation of content, or that Orbit will meet every family’s needs. Any implied warranties are excluded only where the law allows.
To the maximum extent permitted by law, Orbit and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, or harm caused by reliance on location, plans, status, alerts, or SOS delivery. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
Disputes and applicable law
We encourage you to contact us first so we can try to resolve a concern. These terms are governed by the laws that apply to the Orbit operator and your use, without overriding mandatory consumer protections in your country of residence. Any court or forum must have lawful jurisdiction over the dispute.
If any part of these terms is unenforceable, the remaining terms stay in effect. A delay in enforcing a term is not a waiver. These terms, the Privacy Policy, the terms shown at purchase, and any mandatory app-store terms form the agreement for your use of Orbit.
